These Terms of Service govern your use of poiseandpearl.com.

1. Agreement

By accessing or using Poise & Pearl, you agree to be bound by these Terms and by all applicable local laws. If you disagree with any part of them, you must stop using the site.

2. The service

Poise & Pearl is an online style publication offering outfit ideas, capsule wardrobe guides, fit advice, accessory and beauty content, and related printables for women over 40. Poise & Pearl may modify, suspend or discontinue any part of the site without notice.

3. Eligibility

The site is intended for adults aged 18 or older. By using it, subscribing to our newsletter or purchasing a product, you confirm that you meet this requirement. Anyone under 18 may not use the site.

4. Your license to use the site

Poise & Pearl grants you a limited, revocable, non-exclusive, non-transferable license to view and print site content for your own personal, non-commercial use. This is a license, not a transfer of title. Saving our images to Pinterest through the on-site Save button, with the link to the source article intact, is permitted.

5. Restrictions

Under this license you may not:

• copy, modify, republish or distribute site content, in whole or in part, without written consent
• use content for any commercial purpose or public display
• share, sell or sublicense Poise & Pearl printables or their files
• use bots, scrapers or other automated tools to access, copy or harvest the site

• remove copyright, trademark or other proprietary notices
• decompile or reverse engineer any software on the site
• interfere with the site's operation or security

6. Conduct

When you communicate with Poise & Pearl or participate in any space we operate, you agree not to harass or threaten others, post unlawful, defamatory, hateful or obscene material, impersonate any person, send unsolicited commercial messages, or use the site to break any law.

7. Intellectual property

All content on Poise & Pearl, including text, outfit graphics, images, logos, page design, printables and code, is owned by Poise & Pearl or its licensors and protected by copyright and trademark law. No content may be reproduced without express written consent except as allowed in section 4.

8. Reader submissions

If you send Poise & Pearl a photo, question or story and agree to have it featured, you grant Poise & Pearl a non-exclusive, royalty-free, perpetual, worldwide license to use, edit, publish and distribute it in connection with the site, its newsletter and its social accounts. You confirm that you own the submission or have permission to share it. Poise & Pearl may moderate, edit or remove any submission.

9. Style and beauty content

Content on Poise & Pearl is general style information. Fit, sizing and color depend on the individual, and results will vary. Check each retailer's size chart and return policy before buying. Beauty and hair content is not medical or dermatological advice: patch test new products, follow label directions, and consult a dermatologist or physician about hair loss, skin conditions or reactions.

10. Affiliate relationships and advertising

11. Digital products

Printables, free or paid, are licensed for one person's personal use. Paid products are processed by a third-party payment provider whose terms also apply to the transaction, and files are delivered digitally on completion of payment. Because digital files cannot be returned, all sales are final, with one exception: if a file is defective, incomplete or materially different from its description, contact us within 14 days of purchase for a replacement or refund. Prices may change at any time before purchase.

12. Third-party sites

Poise & Pearl links to retailers and other external websites that it does not control or endorse. Poise & Pearl is not responsible for their content, products, pricing, availability or practices. Your use of linked sites is at your own risk.

13. Errors and changes

Content on Poise & Pearl may contain technical, typographical or photographic errors. Prices, sizes and availability change frequently, and Poise & Pearl does not warrant that any material is accurate, complete or current. Poise & Pearl may change content at any time without notice but has no obligation to update it.

14. Disclaimer of warranties

Poise & Pearl is not liable for any failure or delay caused by circumstances beyond its reasonable control, including natural disasters, pandemics, war, terrorism, civil unrest, government action, labor disputes, or failures of internet, hosting or power services.

21. Governing law

These Terms are governed by the laws of the jurisdiction in which the owner of Poise & Pearl is established, without regard to conflict of law provisions. You agree to the jurisdiction of the courts located there, except where the law of your place of residence grants you a non-waivable right to bring proceedings elsewhere.

22. Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be limited to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

23. Entire agreement

These Terms, the Privacy Policy and any notices posted on the site form the entire agreement between you and Poise & Pearl regarding the site and supersede all prior agreements.
